TERMS OF SERVICE

1. Agreement to Terms

By accessing www.oncomedclinic.com, booking an online consultation, or making any payment through Oncomed Clinic's online portal, you ('Patient' / 'User') confirm that you have read, understood, and agreed to be bound by these Terms of Service ('Terms'), together with the companion Refund & Cancellation Policy and the Patient Privacy Policy.

If you do not agree to these Terms, please do not use this website or book any online services.

These Terms constitute a legally binding agreement between you and Oncomed Clinic (operated by Dr. Randeep Singh and Dr. Satinder Kaur), registered at X-10 Haus Khas, New Delhi - 110016.

2. Services Offered

Oncomed Clinic provides the following services, both in-person and online:

3. Medical Disclaimer

3.1 No Substitute for In-Person Care

Content on www.oncomedclinic.com - including Patient Resource articles on Leukemia, Lymphomas, Solid Tumors, and all other conditions - is published for general informational and educational purposes only. It does not constitute medical advice, diagnosis, or a treatment plan for any individual.

3.2 Online Consultation Limitations

  • Online consultations have inherent limitations compared to in-person examination.
  • The consulting doctor may request the patient to visit the clinic in-person if the clinical situation demands physical examination or investigations.
  • Oncomed Clinic does not guarantee any specific clinical outcome from online consultations.
  • In the event of a medical emergency, patients must call emergency services or proceed to the nearest hospital immediately. Online consultations are not an emergency service.

3.3 Second Opinions

Patients are encouraged to seek second opinions at their discretion. Oncomed Clinic does not restrict or discourage patients from consulting other medical professionals.

4.2 Payment Process

  • Payment is collected in full at the time of online appointment booking. No appointment is confirmed until payment is successfully processed.
  • On successful payment, a transaction reference number is generated by Razorpay and a confirmation is sent to the patient's registered email/mobile.
  • Oncomed Clinic is NOT responsible for delays, failures, or errors attributable solely to the Razorpay platform, banking networks, or the patient's financial institution.
  • If the payment is debited from your account but no confirmation is received, please wait up to 2 business hours before contacting us, as bank settlement delays can occur.

4.3 Failed & Duplicate Transactions

  • In the event of a failed transaction where the amount has been debited from your account, Razorpay's automated settlement process will ordinarily reverse the amount within 5-7 working days to the source account.
  • If reversal does not occur within 7 working days, contact us at Oncomedclinics@gmail.com with your transaction ID and bank reference number.
  • Duplicate payments (where a patient is charged twice for the same booking) will be fully refunded as per the timelines in the Refund & Cancellation Policy.

4.4 EMI & Buy-Now-Pay-Later

  • Where Razorpay offers EMI or BNPL options, these are financial products offered by Razorpay's banking and NBFC partners.
  • Any interest, processing fees, or charges levied by Razorpay's financial partners for EMI are solely the responsibility of the patient.
  • Oncomed Clinic does not bear any liability for EMI-related disputes between the patient and Razorpay's financial partners.

4.5 UPI Payments

  • UPI payments are processed through NPCI (National Payments Corporation of India) infrastructure via Razorpay.
  • Patients must ensure the correct UPI ID or VPA is entered. Oncomed Clinic and Razorpay are not liable for payments made to an incorrect UPI ID due to patient error.
  • UPI transaction limits are governed by your bank's daily UPI limit. Patients are responsible for ensuring their account has sufficient funds and permissible limits before initiating payment.

4.6 Chargebacks & Disputes

  • If you believe an unauthorised charge has been made, contact us immediately at +91 88601 03234 or Oncomedclinics@gmail.com before raising a chargeback with your bank.
  • Chargebacks raised without first notifying Oncomed Clinic may result in the appointment being cancelled and the patient being added to a restricted-access list.
  • Oncomed Clinic will cooperate fully and in good faith with Razorpay and the relevant bank in resolving any chargeback investigation.

4.7 Razorpay's Independent Obligations

Razorpay operates as an independent payment service provider. The following are governed exclusively by Razorpay's own terms and policies - not by Oncomed Clinic:

  • Storage of payment instrument data (Razorpay complies with RBI tokenisation guidelines).
  • Security of Razorpay's payment infrastructure.
  • Compliance with RBI Payment Aggregator regulations and applicable FEMA provisions.
  • Any rewards, cashback, or offers provided by Razorpay's banking or card partners.

Patients are encouraged to read Razorpay's Terms of Use and Privacy Policy at www.razorpay.com before making any payment.

5. Website Use & Intellectual Property

5.1 Permitted Use

  • This website is intended solely for personal, non-commercial use to access information about Oncomed Clinic's services and to book appointments.
  • Users may not reproduce, distribute, scrape, frame, or commercially exploit any content from this website without prior written permission from Oncomed Clinic.

5.2 Intellectual Property

  • All content on www.oncomedclinic.com - including text, patient education articles, images, logos, and the clinic name 'Oncomed Clinic' - is the intellectual property of Oncomed Clinic or its licensors.
  • Nothing in these Terms grants any licence or right to use any trade mark, logo, or intellectual property of Oncomed Clinic without express written consent.

5.3 Third-Party Links

The website may contain links to external organisations (e.g., ICON, ESMO, ASCO, ISMPO, useful cancer organisations listed in Patient Resources). Oncomed Clinic is not responsible for the content, accuracy, or privacy practices of any third-party website.

6. User Conduct & Prohibited Activities

Users of www.oncomedclinic.com agree NOT to:

  • Provide false, misleading, or fraudulent personal or medical information during registration or booking.
  • Attempt to access unauthorised areas of the website or its backend systems.
  • Engage in any activity that disrupts, overloads, or impairs the proper functioning of the website or payment systems.
  • Use the online consultation platform for any purpose other than legitimate medical consultation.
  • Record, share, or publish any online consultation session without the prior written consent of the consulting doctor and Oncomed Clinic.
  • Use the website or services in violation of any applicable Indian law, including but not limited to the IT Act 2000 and the DPDP Act 2023.

Oncomed Clinic reserves the right to immediately terminate access to its services for any user found to be in violation of the above prohibitions, without refund.

7. Limitation of Liability

To the fullest extent permitted by Indian law:

  • Oncomed Clinic shall not be liable for any indirect, incidental, consequential, or punitive damages arising from use of the website or online consultation services.
  • The clinic's total liability in respect of any claim arising from online services shall be limited to the consultation fee paid for the specific appointment giving rise to the claim.
  • Oncomed Clinic is not liable for any loss, damage, or harm arising from: (i) technical failures of the Razorpay platform or banking networks; (ii) internet connectivity issues on the patient's end; (iii) reliance on general information published on the website without obtaining a formal consultation.
  • Nothing in these Terms limits liability for death or personal injury caused by negligence, or for any other liability that cannot lawfully be excluded under Indian law.

8. Appointment Terms (Summary)

Detailed rules on cancellations, rescheduling, and refunds are set out exclusively in the Refund & Cancellation Policy (issued separately, April 2026). The below is a brief operative summary only.

  • Appointments are confirmed only upon receipt of full online payment via Razorpay.
  • For cancellations or rescheduling, contact the clinic at least 24 hours before the scheduled time.
  • Oncomed Clinic reserves the right to reschedule appointments due to doctor unavailability, with full rescheduling options or a refund offered to the patient.

9. Confidentiality & Privacy (Summary)

All detailed provisions relating to patient data, health records, consent, and rights are set out exclusively in the Patient Privacy Policy (issued separately, April 2026). The below is a brief operative statement only.

  • All patient information shared during consultations, registration, or payment is treated as strictly confidential.
  • Patient data is processed in accordance with the DPDP Act 2023, the IT Act 2000, and the MCI Ethics Regulations 2002.
  • Patient data is never sold or rented to third parties.

10. Force Majeure

Oncomed Clinic shall not be in breach of these Terms, nor liable for delay or failure, where such delay or failure results from causes beyond its reasonable control, including but not limited to: Acts of God, pandemics, government-mandated lockdowns, national internet outages, Razorpay platform downtime, or NPCI/UPI infrastructure failures. In such events, the clinic will make reasonable efforts to reschedule appointments and communicate with patients promptly.

11. Amendments

  • Oncomed Clinic may update these Terms at any time. The revised version will be published on www.oncomedclinic.com with the updated effective date.
  • Continued use of the website or services after publication of any changes constitutes acceptance of the revised Terms.
  • For material changes affecting Razorpay payment terms, patients will be notified at the time of their next booking.

12. Governing Law & Dispute Resolution

  • These Terms are governed by and construed in accordance with the laws of the Republic of India.
  • Any dispute arising from or related to these Terms, or the use of Oncomed Clinic's services or payment systems, shall first be attempted to be resolved through good-faith negotiation between the parties.
  • If unresolved, disputes shall be subject to the exclusive jurisdiction of the competent courts of New Delhi, India.
  • Disputes with Razorpay relating solely to payment processing are subject to Razorpay's dispute resolution mechanism and the jurisdiction specified in Razorpay's Terms of Use.
